Article 2 – Orders

Article 3 – Item availability
We maintain sufficient stock to process your order within a maximum of 7 days. If we are unable to fulfill an order within 15 days, you will be notified by mail, email, or phone.
Article 4 – Prices
Prices indicated in Swiss Francs are considered net, either excluding VAT (HT) or including VAT (TTC), depending on your customer account status. The applicable VAT is the Swiss VAT rate of 8.1%. All rates may be subject to shipping costs calculated during the checkout process. The full price is payable in a single payment upon ordering. All orders are invoiced and payable in Swiss Francs.
Article 5 – Shipping costs
Shipping costs include a contribution to preparation, packaging, and transport expenses. They are flat-rate and calculated based on the destination of the order.
Article 6 – Payment
You have several payment methods available, offering maximum security guarantees.
You can pay by credit card (Carte Bleue, Visa, Eurocard/Mastercard, American Express) by entering your card number directly in the designated area (secure entry via Sum Up) without spaces between digits, along with its expiration date and the last three digits of the cryptogram (the code located on the back of your card, in the signature area).
You can also pay by bank transfer upon validating your cart; the order will be dispatched upon receipt of the transfer.
Article 7 – Delivery
Deliveries are made to the home address. The average delivery time is 1-2 days for French-speaking Switzerland and 2 to 3 days for German-speaking Switzerland; however, this is not a strict deadline, and Ô Fâya Farm cannot be held liable in the event of delivery delays or stockouts.
Please note: if you choose to pay by bank transfer, the order will only be processed upon receipt of the transfer, and delivery times will be extended accordingly.
Article 8 – Right of withdrawal and product conformity
You benefit from a right of withdrawal which may be exercised within 14 (fourteen) days following the date of product receipt. Exercising this right requires an unambiguous written declaration via our contact form or by mail at your expense. From the exercise of this right of withdrawal, you will have 14 (fourteen) days to return the goods by contacting us so that we can manage the return with our carrier.
In return, we undertake to refund the returned product(s) within 14 (fourteen) days from the date we were informed of your decision to withdraw. It is understood that we may defer the refund until we have received the concerned products or until you have provided us with proof of shipment. Please note: this right of withdrawal applies only if the product is returned unopened: your wine will only be refunded if it has not been consumed. In the event of a corked or deviant taste, please reseal the bottle with the original cork and leave the wine inside the bottle.
Article 9 - Product conformity
Wines purchased on the website https://www.ofaya.ch/ are guaranteed against any defects. Should a bottle be corked, we undertake to exchange or refund it, provided it is returned to: Ô Fâya Farm, Route des Lots 1b, 1976 Aven. In this case, shipping costs will be refunded based on the invoiced rate, and return costs will be refunded upon presentation of proof. In the event of a refund for an item paid by credit card, we guarantee that it will be made by transfer to your bank account within 24 hours following the date of receipt of the returned package. The visuals presented on the site are subject to change and cannot under any circumstances be considered contractual elements.
Article 10 – Online customer account
To place an order via the website https://www.ofaya.ch/, you must create an account accessible via a username and password.
If you are a professional, you can request to convert your account to a professional account via our contact form.
Article 11 – Private use
The videos and books provided are, unless expressly stated otherwise, exclusively intended for private use within the family circle, in accordance with the provisions of the Intellectual Property Code. All other rights are reserved. The term "private use" specifically excludes any screening in public places such as clubs, video libraries, buses, boats, bars/tobacco shops, hospitals, hotels, oil rigs, prisons, and educational institutions... Article 12 – Transfer of ownership – Transfer of risks
BY EXPRESS AGREEMENT BETWEEN THE PARTIES, THE SELLER RESERVES OWNERSHIP OF THE GOODS SUPPLIED UNTIL THE DAY OF THEIR FULL PAYMENT BY THE CUSTOMER. NOTWITHSTANDING THIS RESERVATION OF OWNERSHIP, THE CUSTOMER SHALL REMAIN RESPONSIBLE FOR THE GOODS FROM THE MOMENT OF THEIR DELIVERY.

Concerned with protecting your privacy, Domaine des Petites Planètes treats all information concerning you with the strictest confidentiality. During your purchases, we only request information essential (name, first name, address, phone, email) for quality processing and attentive tracking of your order. This data entered online is recorded on a secure server in Switzerland hosted by Infomaniak. We undertake not to disclose it to third parties and to use it only to process your orders and keep you informed of the evolution of our offers. The products offered comply with current Swiss legislation. The liability of Domaine des Petites Planètes cannot be sought in cases of force majeure. Cases considered as force majeure include, indicatively and non-exhaustively: strikes, lockouts, riots, revolution, mobilization, war, epidemics, official prescriptions, transport or mail delivery difficulties, machine breakdowns, fires, accidents, or material damage occurring during works, transport, handling, or storage, supplier failures... Biodynamie & Cie disclaims any liability regarding the content of sites to which hypertext links may lead from its own site.
Article 16 – Applicable law and jurisdiction
All disputes concerning the validity, execution, or interpretation of these terms are subject to Swiss law. The exclusive jurisdiction is Sion.
Article 17 – Buyer acceptance
These general terms and conditions of sale, as well as the rates, are expressly agreed to and accepted by the buyer, who declares and acknowledges having perfect knowledge of them, and hereby waives any right to rely on any contradictory documents, and in particular, their own general terms of purchase. The act of purchase entails acceptance of these general terms and conditions of sale. These terms are modifiable at any time without prior notice.
